Proposed Changes to VPHOA Restrictive Covenants

Article III, Section 4: Parking rights and restrictions (page 5)

Change to read:

...and agree not to park their automobiles, trucks, boats, trailers and other vehicles on common areas of the property. No large (over 1 ton) commercial vehicles shall be stored, housed, or parked on the property except in an enclosed garage. Boats less than 21 feet, on trailers, and small utility trailers may be parked in back/side yards if shielded from view of the street.

Article V Voting rights (page 6)

eliminate references to Class B membership.

Change to read:

Section 1: Classes: The Association shall have one class of voting membership, the owners. Each owner shall be entitled to one vote for each lot owned. When more than one person holds an interest in any lot all such persons shall be members. The vote for such lots shall be exercised as the owners thereof determine, but in no event shall more than one vote be cast with respect to any lot, and no fractional vote may be cast with respect to any lot.

Article VIII Architectural Control (page 11)

Allow small satellite dishes, TV antennae, and clothes lines in backyards.

Change to read:

No building, fence sign, wall, or other structure shall be commenced, erected, or maintained upon the property, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, materials and location of the said improvements or alterations shall have been submitted to and approved in writing as to the harmony of external design and location in relation to surrounding structures and topography by the Architectural Committee. Satellite dishes smaller than 30 inches, as well as small digital television antennae and permissible when mounted in the side or back or houses and yards. Clothes lines are permissible only in back yards.

Article XII, Section 3: Amendment (page 17)

Make it easier to amend the covenants.

Change to read:

This declaration may be amended during the first twenty (20) year period by an instrument signed by owners of not less than 90% of the lots, and thereafter by the board of directors after receiving written approval from owners of not less than 70% of the lots.


Proposed Changes to the By-Laws
Article III, Section 1 Annual Meetings (page 3)

The annual meeting shall be held during the month of June each year.

Article V Nomination and Election of Directors (page 4)

Change to Read:

Article V: Nomination, Election, and Removal of Directors

Article V, Section : Board of Directors

Change to list the current board of directors.

Add a Section 4: Removal of Director(s)

Any director may be removed from the board for just cause by a majority vote (50%) of the property owners.

The above changes are only PROPOSED as suggestions. The Board of Directors welcomes suggestions for changes to the Bylaws and Rules.
